I recently applied under 0213. I agree process is not as complicated as it sounds also I am not sure what value add a lawyer will do apart from keying information from you in the forms. My suggestion - do it on your own. Lets not bash anyone here. IEEE might sound anti-immigrant on the surface in true sense, its only anti H1B for all the right reason. I am not trying to defend IEEE but just getting the facts straight. Please check the attached file which is a letter sent by IEEE-USA president to Gov of Minnasota.

On the surface, yes, IEEE-USA supports EB visas and opposes H1-B visas. But if you take a closer look, its not as clear cut as that. What they really want is to restrict immigration to the most exceptional foreign scientists and engineers (roughly those who would qualify for EB1), and make the path to a GC faster for them. They are dead opposed to foreigners being hired for general engineering jobs, and the current practise of almost everyone on an H1-B being eligible to apply for a GC. I would think twice before calling them a friend to any of us; they are at best anti free-trade restrictionists minus the rabidity and political incorrectness of our "friends". A while ago there was a discussion on IEEE-USA's reaction to CIR, where they expressed displeasure on the increase in H1-Bs along with the increase in permanent visas.

I work for company A in india which has a subsidary company "B" in US.
On "B"'s request i worked in US for company B from July 2006 to Nov 2006 (for which i have valid pay checks).
I went back to India and worked for A till June and i came to US again to work for Company B.
Now as soon as i entered US, i have applied for a premium H1 company transfer to Company C.
Now i got a query to submit my Pay checks which i do not have as i resigned Company B after coming to US.
Please suggest me whats the ideal way to answer this query...

With due sympathy for affected folks, you really can't blame US govt for this. The law had H1B with dual intent and work constraints based on LCA and H4 as a dependent visa and not eligible to work.
Why? I don't know. Is it fair? Maybe not if you consider that L1 dependents can work but US govt did not have such provision for H1B dependents.
But that has been the law even before you got married and came here. If you did not know that you can't work on H4 then it's your own ignorance. Blame your spouse for not mentioning it to you or blame yourself for not asking that question or blame ignorance that you were not aware that would happen. There have been spouses who came here on H4, transferred into H1 because their skills were marketable (Marketable in the sense that companies (not body shops) were willing to get into the hassle of an H1B) or chose to pursue further studies, arming themselves with an US degree and made themselves marketable. Some took up unpaid internships for a while, thereby gaining experience, and when the opportunity presented itself were able to get an H1. some others took up volunteering jobs nearby.
Frankly, US govt is not responsible if you did not do your due diligence before getting married.
Now, that said, I think it would be great if H4s are allowed to work considering that so many are well educated and possibly skilled and trained. Take up the cause and enlist more people and try. Nothings impossible. Good luck.

I second that. Ranga, from NJ had an idea about making a documentary to project the whole issue
Can we form a Human Chain protest across the major cities of the country at a predefined date and time. for instance, say Nov 9th between 11.AM and 1 PM.
This way more local people, across the country, can participate and as the timing is around lunch hours, I presume many of us can get back to work within the two hour duration.
May be this decentralized & concerted effort in all major cities/states across the country at a specified time may gather main stream media attention.
This is just a thought...

hey guys quick question...my existing AP just expired yesterday. however I had applied for AP renewal 120 days in advance and received an approval in Oct. The problem is the new AP that I received in Oct is valid from Oct 2008 until Oct 2009 even when I had a valid Ap until Dec 2008. So basically I lost 2 months when I reapplied for AP. Can I do anything to get 2 months added?

I have never lived in Canda but married to a Candian citizen so I am writing this with her help and with my limited knowledge. I don't think 50K per year is enough, you may survive but living standard won't be as good, say, compared to Texas (if you are in CA then its different comparison). You pay more taxes, high insurance premiums, clothes are expensive etc. everything is higher. As per my bro-in-law, the sale price of houses in Houston is less that the cost of building house in Toronto (he is a financial consultant in Toronto). I heard socially Canada is better than US and have nicer people.
Heathcare is free (not dental, vision etc.) but you eventually pay more taxes for that so if you are planning to bring your parents this could be good but for healthy young family basically you pay more taxes for health of others. Healthcare can be compared to US but not as good because there is cap on doctor's income (300K??) and many good doctors move to US.
TN is defnitely good and hopefully it will remain for canadian citizens and can be renewed with no cap for maximum years but but your dependents can not work with your TN visa.

I was 100% determined in the beginning to attend the rally, but could not for the following reasons.
1> I was in Dallas and family in SoCal for last 9 months(from Dec 2006 to be precise). I used to meet my family every other weekend. Was trying very hard to find a project in Socal, and finally I got one where joining date was Spet 13th. I could not dare to ask for leave in the very first week. To tell you the truth it took so long b'cos of H1 status, everybody wants me to transfer my H1 or they are looking only for GC/EAD holders. Hoping to get EAD soon.
2> My husband was planning to attend but somewhere in Aug last week we got FP notices and date is Sept 18th. The FP letter clearly mentioned that postponing might cause delays so we decided that he also has to drop the idea.
Of course we contributed towards the rally.
I am very proud to be part of such excellent grass root organization and now since I am in Irvine I can be active in Socal chapter.
Also we are eager to join in the next rally and have total faith in IV leadership.

I agree 100 %. But even if the officer wants to know about out I 140, it wud be just a 1 min process for them as they can check if a recipt was generated based on the names.
If we put the copies of the fee checks, that would help even more because that means that our I 140 application was accepted.
With tracking receipts, cheque copies and a letter, I believe we would be able to establish evidence that, 140 was received by the service center.
Totally missing out on showing that I 140 is filed is no evidence at all. Showing every possible document to prove that the docment was filed, should be do the work.
Anyways since there are so many hundreds of people who filed I 140 in the recent days, I believe some alternative from USCIS wud show up in the next few days .......

First of all please forgive me if this is a repost. I will be grateful if you could point me to a previous discussion. So, here's my problem.
I work for a client A. I got this contract through a layer of vendors. SO my relation with the client is like this.
Me > My Employer (ME) > Vendor 1 > Vendor2 > Vendor 3 > Client.
Now, I want to transfer my h1 to Vendor1. My employment agreement with my employer says that within 12 months of my termination with the employer, I can not have relations with any company (in my case vendor 1) that i got in contact through them. My client also has agreed to renew my contract through Vendor 1. So that would mean that Vendor 1 will have client as a direct client.
I have been an employee of my employer for 2 years now. ANd vendor 2 is really giving me a good offer.
Can my current employer do anything legally if I transfer my h1 to Vendor 1? Please help.

I understand that you guys are frustrated but I did not open this thread to make empty noise. I have written to six different organisations and ACLJ only gave me a reply that they would be unable to process our per courntry quota lawsuit. There are thousands of federal court immigration lawyers in the country who would do this lawsuit albeit with more money than these non profit organisations. If any of you guys want to make a difference in your lives and lives of others pls co-ordinate this event of contacting various immigration lawyers.

I called the USCIS just now, and they told me that they can tell the receipt number to ONLY my attorney or my employer, provided its already in the system. I filed on July 5 ( NSC), and hasn't got the receipt number yet. There is only one person in my company to handle hundreds of GCs, and the person is very busy processing all these I-485s, and will not pick the phone for any enquiries, no reply for emails etc. so i am stuck! so i dont know whether they encashed the check or not!

My experience with FDBL ( Filed through #1 DataStorage Firm) has been good till now. Informed well ahead, filed on time. LC processing took a bit b/c of general LC filing norms but LC cleared in 20 days and I140 in 7 days. Guess they did their paperwork and all right.

I understand they are forwarding some appls to Texas from Nebraska.
And Texas is much faster.
I got to know from my attorney that, USCIS has my I 140 information in their system and they gave him a receipt number. But, the receipt is not generated yet. It may take a week or so to get the receipt. My appl was filed on 12th and it reached NSC on 13th.
I checked the status online with this receipt # and online status shows that they recieved the aplication on 19th and its at Texas center. May be my appl was moved to Texas now.
