Hi,
My H1 was filed as an individual application while i was in India last year by a consulting company.Later in May 2007 i was transfered to US on L1B.
Since then i'm in US and now i have taken a vacation off, and during this i wish to appear for H1 stamping interview.
Supposedly i get my H1 visa stamped, i am hoping i will be able to travel to US but that will be on H1 with a new Employer, but i should be resigning with the old company once i reach there. (Please correct if this legal because my old company still thinks i am on L1)
And other hand if i'm not able to make it through stamping, my old L1 status is still valid ?
Please clarify the above doubts ...!!

I am paranoid about losing my GC with me since I have on more than one occasion left misplaced my wallet, or left it at a restaurant, friends place, etc. Thankfully it has been returned to me with all contents intact and untouched every time. I do know that my luck will eventually run out so my question is this. Can I carry a photocopy of my GC instead and probably leave the original locked up in a firesafe at home? (I do not live in AZ, BTW)

H-1B employers need to be aware that June 30, 2009 will be the last day that the Department of Labor�s LCA Online system will be operational. As of July 1, 2009, all LCAs for H-1B and E-3 cases will need to be submitted through the iCERT portal (http://icert.doleta.gov/) and that means the end of instant LCA certifications.
This has very important implications for the timing of H-1B and E-3 applications as they relate to new hires and extensions. Employers will need to allow for delays in LCA certifications of at least 7 days rather than the instant certifications that were previously issued.

My wife's finger printing fee was rejected last month even though we sent the correct fee. We sent the fee again.
But in the mean while, we also recieved our finger printing notices. Does anyone know as when we would get our EADs ?

Hi,
What is the difference between "reject" and "deny" in USCIS terms? Is it that reject is even before the case is processed and when application is returned back immediately and "deny" is later when the case is looked into and then the aplicant is found ineligible for whatever reasons?
If this is indeed the case how much time does one have after getting an RN to submit additional evidence he/she may have missed initially but before the case is processed?
any ideas from the adjucators manual?

First of all I am filing by postal mail USPS(not e-filing)
1)is it necessary to include I-765 receipt notice(EAD) with my AP application.. But I have only my last years one which will expire in a few months.
2) for AP renewal is it necessary to include marriage certificate for spouse
3) When filing by postal mail, and also considering i applied my I-485/I-140 before july 30/2007, old fee schedule... do i need to pay biometric fee for my AP renewal
4) I am in Texas and for mailing EAD and AP - can I send them together for me and my spouse. I see different PO Boxes for EAD and AP addresses for the Mesquite, TX address
IN I-765, is it enough only to specify the previous EAD information regarding the office filed and receipt date...or do i have to include my OPT EAD as well as my previous EAD filed last year.
Any clarification is highly appreciated

This survey intends to understand the needs of our membership for this provision and collect grassroots information.

So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

I have I-140 approved and waiting for PD to become current. Wife , however, is from ROW country and i am looking to applying I-485 for both of us using Cross Chargeability.
Is Cross Chargeability guaranteed to work or do USCIS employees have a discretion if they approve it or not ?
After researching a lot it seems like lot of people have had a hard time in being successful in conveying their CC eligibility to USCIS. What is the difficulty in conveying CC eligibility to USCIS? It seems like people mentioned about their CC in a cover letter to their I-485 but USCIS would miss reading or understanding this information. What is the secret to successfully conveying CC eligibility to USCIS ?
