gimmeliberty, srinivas_o, x1050us, PKV4voice thank you so much. I was out for about a couple of hours and when I came back I saw all these contributions lined up. I cannot express the feeling I got. I was totally overwhelmed. After yesterday’s round, which took about 24 hours to close (estimation, I didn’t check), I was worried if we will be able to finish this round. Between Fragoman, My Company and USCIS they sure are going to drive me nuts. I am waiting for green card for 10 years now with the same company. They are moving EB2 date and nothing gets done with EB3. On top of all these, 2 years from now, they will make all dates current which literally mean I will get my Green Card with a guy came here 10 months ago....

It is simple. If the number of pending EB2 Apps before April 1st 2004 (India and China combined) is less than the number of spill over visa numbers, then there will be some forward movement in EB2 next month. If not, the dates will remain the same or may even retrogress.
what I am trying to say is USCIS works effectively for EB2 category as because they dont have much work in other EB categories.

My husband has been working on H1B with a leading company in USA since early 2000. Our Labor was filed in March 2005 and is stuck at BEC. I am on H4 and am not able to work or contribute.
One of our friends starting working in USA through a consultant in late 2004. Filed his I-140 directly with a substitute PD in June 2005. They received their EAD same year in October 2005 and received his physical Green card on February 2006 . He used a priority date of 1999 due to his substitute PD. Now he is a free bird and can move jobs, his wife can work and they receive all the benefits of green card.
How fair can this be?
We are unable to move, take up a better job, receive a promotion or take up fulltime studies even after getting admission in best Universities due to our Visa situation.
Sweeping changes are necessary in immigration rules and the date the person starts to work on H1B should be considered as the priority date. It will eliminate lot of corruption and reward those who truly contribute to the economy.

With the economy turning out the way it is I wonder when we will get our next opportunity to bring our issues to Lawmakers notice and ask them to work on our issues. We need to speak up now and we need $$ to fund our organization. I was talking to my mentor syesterday and he is on the board of directors of an organization. He was mentioning to me that if people are losing Jobs, not able to pay their mortgages and struggling to pay for gas and food all other issues will be put on the back burner and the focus on immigration related issues might go down. I am still trying to sink that into my head

First of all why do U wanna ask that? Its an employment based visa that ur GC is based on. So, ur employer shud ask that. Why are u asking IVans to do something which is not in their control??? I keep getting red and dont mind if I'm banned. But excuse me...u r misleading IVans. My point is this. We can protest, rally based on the delay. Thats pretty much we can do. Inquiring into a Government agency's internal affairs is none of ur business. And I repeat u dont have any rights to do that as u have NO direct link to USCIS. U have applied thru ur employer and ur employer shud speak for u. Do u even get it? Ur statements and arguments have no logic whatsoever and misleading.
