The absence of I485 receipt may be an issue, because they would put a stamp on that paper after taking your (I485) FP. They would do the same on your EAD FP notice letter.

Hi,
My kid brother (15 years old and US Citizen) lives in India with my parents. They are quite elderly now to take care of him and we were thinking of bringing him to US legally to live with us. We want to adopt him so that he can have a good lifestyle here and have no issues legally in future. Is there anyone who has gone through similar case before ? Also, I wanted to ask if there are any attorneys that specialize in cases like these ? If so please let me know and I would like to hold a consultation asap.

Hello everyone,
I had filed for my I485 on 19th July at Nebraska. My 90 days are getting over on 19th Oct. Still I have not received any receipts for I-485,EAD,I-131.
My lawyer is going to call USCIS to inquire about my case.
Does any one had experience calling USCIS after 90 days were over and the USCIS tracked your application and you got your receipts.
Would be great if any one can share there experiences.

For the first time I think IV was put ahead of AILA/AILF in immigration issues when it mattered. I think finally immigration community can have sigh of relief because immigrtaion community is not represented by a bunch of attorneys who make money on immigration issues (which are legitamate or not ) but by a grass roots organization of immigrants. Congrats to IV and its members in resolving july visa bulletin fiasco. Long live IV

Employer B wishes to recruit me by transfer H1-B and utilize recapture time. The total time they would get is till Apr 2010 (which includes recpature time) along with 7th year I-797.
Employer B wishes to file LC 1 month after I join them.
Assuming that I join them by end of Dec 2009, I have the following questions about my H1-B extension
Lets consider Dec 30th as the date to start the LC application.
What I understand is that based on the LC from Employer B,
Can I get extension on my H1-B beyond APR 2010.
for 1 yr - Based on LC from employer B being pending/approved until Apr 2010
for 3 yr - Based on LC from employer B being approved and I-140 approved.
Apply for premium processing of I-140 before 60 days of Apr 2010 if LC is approved and I-140 is pending.

With I 485 pending you need an EAD to be able to apply for a social security number. I believe it is not uncommon for parents to apply for employment authorization for a minor to do just what you are asking.

USCIS has specifically answered a very similar question in 2004. The answer is "A change of status take effect automatically on the effective date noted in the [approval notice], even if there is an intervening admission...."
Your H-1B status should therefore take effect automatically on 10/1/09, assuming it was approved as a change of status.

Hi,
I hold a H1B Visa from Company A, which is valid until Sep 2010. I have not used this Visa since the stamping is done.
I am working in India from an X Company and because of the recession and bad job market at US, I did not make use of my H1B Visa.
But now my Employer (Company A) has an in-house project in US. So, I am planning to enter US on my H1B Visa now.
1) What documentation is required to show at the Port of Entry?
2) Since my Visa is going to expire by Sept 2010, which is just 6 months validity, will there be any issues / queries at the Port of Entry.

My OPT ends dec 08 and my H1 got selected in lottery but received RFE in Oct and case is still pending. Can I go for OPT extension right now as there is just 1 month time to file it?? Or should I go for premium processing of H1 and then go for OPT extension filing depending on H1 case result??
If I go for OPT extension right now even when H1 case is pending,
1)What happens to that OPT extension case if H1 gets approved?
2)What happens to that OPT extension case if H1 gets rejected?

Hi
My wife is on h1.Her staffing company did not have a project from july 1st.
I applied for her h4 cos on july 7th.
Her company had applied for h1 amendment for change of location in may.status shows pending.
My question- are we safe in applying for h4cos on the basis of old approved h1.does the outcome of amendment h1 even matter, since there is no project anyhow and the person has applied for h4.

If you can wait for AP to get approved that would be a better choice. When did you applied for AP? I know couple of my friends whose AP got approved with in a month. It all depends on case to case. Don't take it granted as 2-3 month.

I have a question regarding the I765 form. In the I 765 form it says Have you ever before applied for EAD to USCIS. I did my MS from US University and got OPT also known as EAD and worked on it for an year. Now my question is do i check yes or no? Do i consider that as EAD or just OPT.
