Appu, what abt labor cert? Does this advanced degree-holder still have to go thru labor cert? If yes, then the person with advanced degree but no experience has no advantage.

degrees in STEM have been classified (by Section 406) as Schedule A.
Which means you file ETA form 9089 directly to USCIS NOT to the DOL.

Yes, we need more help from the media. That is why we have the media event - press conference on Tuesday June 8th. We need members to be there to show a good representation of EB-Community. Apart from that we need to send these emails/letters to media and the reps in 1000's everyday, so that we get the attention we deserve. Thank you everybody that is participating and sending emails every day. We can also print out and send letters.

I was also put into "EB3-India" forcibly by my employer - they love to see me chained , you know !!
The only future i see for EB3 India folks is charge your EAD and do "W2 Consulting" or "1099-Consulting" and make money...... Dont worry about "future employment letters" or that "last minute RFE"... That RFE is not going to come before another 5-6 years at least. If by chance your time comes , then get a permanent Job and get a "future employment letter " from them.
The whole thing that i wrote above is absolutely legal. As long as you stayed with original GC sponsor for 180 days+ after 485 application and had intention to be with them ( that time 5-6 yrs back) had you got GC - You should be GOOD...
Get it going folks - that's our future :)

What does the introduction of SKIL bill in House mean to us? i.e. what are the likely scenarios from here on? Thanks in advance.
It seems tough to have this being passed unless CIR dies. Only 10 weeks are left for any bill to be debated and passed by both houses. In my opinion it is very difficult. I would personally wait to hear opinion about this bill by legal experts and media. It is too early to speculate on its failure or success.
btw. If Uma Thurman endorses this Skil Bill it will definitely get passed!!

Please provide good reasons to purse EB3 to EB2 thru another company. I am not getting enough motivation or strong points to port from EB3 to EB2. Please provide serious input. I will definetly purse new job for porting.
Some of the reasons in my mind to go for EB2 thru new job:
1. Immigration freedom (like financial freedom)
2. All new and old eb2 filers are going to get green card before me. I am not jelous about them if I have filed my case recently. But my filing happend 7 years back. So, I should really think about it but not in terms of jealous.. it could be shame on my part...
3. Immigration rules and regulation fluctuations..
4. Early GC means, early citizenship. Chance to survive here in Federal, Navy, Army IT jobs with security clearnace if get citizenship early. Otherwise, govt. sector will also be saturated. My position is taken away just because of not gettting early GC.. Too much think ah!!

1. Unneccearily touching the immigration process one more time and is kind of risky when INS dig deep into and do micro auditing the old and new filings. Though my case is strong,, they some time create tensions... you know what I am talking about..

3. After spending lot of years in North East winter weather, I moved to NC. Good place in terms of everything. If I start looking for job, not sure whether I get here or somewhere in cold.

Not able to buy home due this EB3/EB2 porting in my mind. Because location change may happen if I decided to go for porting and place change happens due to that. And also not sure whether I need to look for Desi employer or corporate. I am with corporate now.. decade.

In june 2007, USCIS did'nt reach June 03. But DOS pushed it to use up numbers. The dates are basically a dance between USCIS and DOS and it is based on demand from the previous month or qtr. Yeah there are tons of people who got their GCs with PD 03, but there are tons more waiting in 02 to get their GCs. I do agree with the Labor black market that flourished which adds more complications to the progress. The only way PD moves to 2005 in the next two years is by luck or DOS calculates it wrong (like they always do)

Sorry for late jumping on this old topic. But, applied for SSN for my wife and got it in mail. Now what? My taxes for last year were applied in feb this year. How can I tell IRS that my wife got SSN now and she is eligible for Stimulus package?
Can I claim this amount next year when I file my taxes?

USCIS does not work for you or me but sure you can go and ask them for prefiling AOS but not to issue RFE for same job requirement condition and other haressing rfe. how can you say we cannot ask USCIS not to raise RFE for irrelevant stuff,I guess you are ok with all the RFE that are being issued by USCIS on h1 holders currently. Sure some of those rfe are valid ones but vast majority of them are to kick h1 out. Does USCIS or any other department issue rfe to GC holders when there is something "fishy" as you put it. Like I said as long as you work in the relevant field in which your labor got certified we can ask to be left alone. Its one thing to get an rfe for birth certificate, medical records and another thing if you are issued the sort of rfe that are being issued to h1. You and all the people who missed out on July fiasco obviously want to file AOS and get EAD at any cost (i understand and support that ) but what about us who have been here for 5 to 10 years and took us multiple years of wait to file AOS and get EAD. Without strengthening AC21\EAD and allowing everyone to file AOS is going to attract USCIS, grasley, sanders and all anti eb folks attention.
You have a great plan, come to US on H1 and within 6 months get EAD and you are free from H1b crackdown by jumping to EAD. You think USCIS, Grasley, sanders, and anti eb folks are a bunch of idiots, they will send you and me packing with the same rfe they are hitting h1 folks with if everybody gets to pre file AOS and get EAD. that is why you need to strengthen ac21 by removing same\semilar job condition and other potential h1 like rfe's, otherwise you will drag us down along with you and turn ead into h1.

My employer sent in 30+ applications on July 2nd and said he doesn't know which one is my tracking number..but i guess i could use any one of those 30 tracking nos for proof, couldnt i?

If you are a legal resident of the US, such as an H4, even if you are a child, and you have an ITIN, you can get a Social Security Number, because that is the only way to get the Economic Stimulus Payment.
Be forewarned that the SSA will put up road blocks. You will likely be denied your first application. However, the law is clear and there is no cost to apply. You also have a right to appeal. A cover letter explaining why you have a RIGHT to a Social Security Number will help support your case. You letter should refer to the laws and statutes cited below.
The only way to get the stimulus payment is to obtain a Social Security Number for "non-work" purposes. The SSA may issue an SSN to an alien under the following provision:

Lawmakers included the identification requirements to HR.5140 under the belief that all legal residents of the United States will hold Social Security numbers. Therefore, it is incumbent upon the Commissioner of Social Security to "take affirmative measures to assure that social security account numbers will, to the maximum extent practicable, be assigned to all members of appropriate groups or categories of individuals by assigning such numbers" [Section 205(c)(2)(B)(i)] and that all qualified individuals receive "financial relief" under H.R. 5140 according to the stated will and intention of the United States Congress and Senate (as described in the links above).
Be forewarned that the SSA will put up road blocks. You will likely be denied your first application. However, the law is clear and there is no cost to apply. You also have a right to appeal. A cover letter explaining why you have a RIGHT to a Social Security Number will help support your case. You letter should refer to the laws and statutes cited below.
The only way to get the stimulus payment is to obtain a Social Security Number for "non-work" purposes. The SSA may issue an SSN to an alien under the following provision:
20 C.F.R. � 422.104(a)(3)
(i) You need a social security number to satisfy a Federal statute or regulation that requires you to have a social security number in order to receive a Federally-funded benefit to which you have otherwise established entitlement and you reside either in or outside the U.S.;

The Social Security Administration is required by federal law to issue Social Security Numbers to legal aliens who require them to receive federally funded benefits under Section 205(c)(2)(B)(i)(II) of the Social Security Act, which states that the Social Security Administration is required to assign an SSN to "any individual who is an applicant for or recipient of a benefit funded in whole or in part with Federal funds."

The law also clearly states that qualified recipients of this benefit must have social security numbers to receive these funds. No other identification number is considered permissible. SEC. 6428 (h) (2) "Identification Number Requirement" states, "For purposes of paragraph (1), the term `valid identification number' means a social security number issued to an individual by the Social Security Administration. Such term shall not include a TIN issued by the Internal Revenue Service."
According to SSA document 20 CFR Part 422 [Reg. No. 22] RIN 0960-AF05 Evidence Requirements for Assignment of Social Security Numbers (SSNs); Assignment of SSNs for Nonwork Purposes, a "valid non-work purpose" results when the "law requires an alien who is legally in the U.S. to have an SSN in order to receive general public assistance benefits (i.e., a public benefit that is means-tested) to which the alien has established Entitlement."
The means-testing provision of H.R. 5140, the Economic Stimulus Act of 2008 is stated in SEC. 6428 (d) Limitation Based on Adjusted Gross Income.
The federal government has also defined H.R. 5140 as a form of financial relief to persons who fall within certain income categories. According to a Whitehouse publication explaining the means-testing provision of H.R. 5140, "This relief would be available to everyone with adjusted gross income less than $75,000 for singles and $150,000 for married couples filing jointly. It will be phased out for taxpayers above those income thresholds. Taxpayers may qualify by filing a tax return for 2007 and including a valid Social Security number on their tax return." Ok, firstly, if you are really honest about your feelings, no one is really happy for another unless what the other has done is useful to you. You can wax your eloquence with claims to contrary, but you know it is true. So stop this pretensions.
Ok, you want a constructive suggestion? Rat on everyone who is doing fake jobs, is a body-shopee, bought his GC etc. That should get rid of at least 20-30% (conservative numbers). How many will support it? I guess not many.
How about asking USCIS to make the priority date of the substituted applications to be the day 140 is filed? Any takers there? I guess not.
And then people have the gall to tell us to be happy for Eb2ers, and that we are jealous.
PS: I realize that substitution is no longer possible, I mean to ask USCIS to retroactively apply the priority dates for such cases.

Now, the bad part ... the achilles heel of every high-skills amendment is the tethered H1B quota tricks. They are exempting everyone who has US masters or a non-US master in STEM from H1 quota, effectively making H1 quota = A LOT MORE.
Are you saying the future greencard applicants will have to compete with lot more new H1b s?? Wouldn't this bill help alleviate the retrogression problem and those with approved LC, I-140 etc??
