Thought this may be some helpful information. I contacted an attorney and she showed me a recent circular (dtd. Spet 26) from AILA about premature I-485 approvals and how that can be corrected through an AILA liasion. So, Alias, looks like your attorney followed the same procedure.

This press release only shows that it is an administrative/executive fix. Either it is USCIS or DOS or the President, is what I do not know. But clearly, it is something not mandated by legislation, else USCIS/DOS would be breaking several laws by continuing to use the old bulletein.

There is a logical fallacy here. What you are saying is:
Suppose country quotas exist to limit abuse
There are country quotas
Therefore abuse is limited
The very fact that you are complaining about abuse in the system disproves your proposition.
it's very easy to make assumptions of how the system works in this country when people want a solution that fits their own particular needs.
When people have been part of this society for less then 10 years; it is a very, very short time to understand how the system works and the whole history and what goes on behind the scenes.
I've said this in the past; many people walk around with eyes wide shut. Do some really exhaustive work of the history of immigration; the debates that happened when the laws got created; what has passed, what hasn't; what uscis/ice/dol is doing; request for evidence, denials, consulate refusals; underbidding of contracts, etc.; you may come up with different conclusions then what you may currently believe.

No its I-485 I just cut and pasted the two emails I received, first at 10am then the second at 3 pm check online and the system had same messages. If its true I am having a party wow man thanks I did come to US in 1997. I do have a labor which was approved under RIR PD date 2004 but the employer refused to file I-140. Then again filed PERM in 2007 under EB2 and filed I-140/I-485 based on this PERM

Not to scare you but USCIS Can make mistakes.
In our company we have an immigration chat alias and my colleague' friend's
wife's GC was approved and after a couple of months she got a mail saying that
her GC was approved by mistake and it is being revoked!
She hadn't event applied for EAD renewal since her GC was approved.
Now I am not making it up.
I don't have any more details about this case but I read this on our alias.

I know you have been correct in the past but I think we have just gotten over the hump of 2003 and a small portion of 2004 for EB2. The majority of 2004 and early 2005 still remains. There was a huge jump in March 2005 to beat PERM. I dont understand how it will reach 2007
Here are all the LC approvals for India in the last seven years.

Based on the labor approvals, I am expecting EB2 will touch 2007 in the next 3 to 5 visa bulletins. Since, till late 2005 EB2 is current only. Say there are about 10 thousand back log EB2s and they need 10thousand *2.5 visas= 25 thousand visas.Because in 2006, 22298 labors been approved, say half of that means 10 thousand are EB2 and 10 thousand *2.5= 25,000 visas are neaded to clear offf all 2006. So to clear all EB2s till 2006 Dec theres a need of 50k visas. But due to the spillovers we are getting 50k visas in 2008 fiscal year itself. So for the year starting with 2009 theres a strong possibility of EB2 PD to move to 2007. And before and after PERM there are very few applied for Labors. After the good news, I can apply for 485, But I have
a question. My wife she came on H4 here and then converted
to H1B and get stamped also. Is it going to be a problem if I apply 485 for
her ( because of H1B) and if its not a problem guide me what are the necessary documents
for her.

Though bigtime's comment was inappropriate it was made in a thread for BEC victims and thus banning him was a complete mistake. There should be a certain criteria for banning people. I have been with iv for last 2 months and only issue I found is this intolerance for difference in opinion. I guess its ok to ban someone who 2 days back went on and on abt why spouses shouldnt get EAD etc, his general tone was completely against wht we all stand for. Yet I think he wasnt banned and this poor guy was banned when he just showed his frustration.

1. Bes tway to take 401K out is to rollover the 401K into Roth IRA and then withdraw from the account after 5 years. You can save lot on taxes.
2. For all H1b holders, there is a form which you can fill and submit to IRS which says you want to get all the SSN money back. But once you fill out this form and get the money back, you SHOULD NEVER enter US for any reason. I do not know what the form is.

There are a few things missing in SKIL bill that we would like to get introduced. Mainly its the 3-year extensions of EAD and AP and 3- year ext of H1 for labor applicants that is missing.
We are also trying to assess of SKIL in house is gonig to go forward, and in the event it doesnt, what other bills can be vehicles for putting our provisions like the S 1932 style.
