My earlier offered me ticket to my home country when they let me go. They specified in letter that they are offerring this according to the law. But I think its not neccessary to have employer to send termination letter to USCIS. Actually person can request company to stop sending this letter if employer is intend to. This way employer will not going to loose anything.

I am in EB2 ADP with PD Feb'09. No cheating there ! :)
I understand that if a lot of EB3 guys, who have been waiting for years, start porting to EB2, they will end up in the queue before me :(. And with that knowledge, I will still support EB3-EB2 porting.
EB3 guys, porting is your best option. I hear a lot of EB2 asking you to go get a new job where they are willing to
a. Hire you with your H1B status,
b. Agree to file your GC, and
c. Agree to do it in EB2 category. (Think about the min wage they have to give and prove etc.)
It is way easier said than done in the current economy. But if you find one, go for it. That is a way of respite for you folks. For others, try porting to EB2 with your current company.
There have been cases where EB3 was filed when the candidate was eligible for EB2 and there have been cases other way round too. But talking about none of them helps your cause. Similarly, fighting amongst us doesn't help either. Don't get me wrong if I say that with EB2 movement, if EB2 becomes current by the end of next year, EB3 will start seeing a good benefit of spill overs. So with current laws, getting EB2 out of the way will actually help your cause
Eliminating per country limit will help everyone. We should fight for that, EB3 and EB2 together.

Its good that we have a democratic majority in congress. we also now have work cutout for us to contact new lawmakers. getting more members and members willing to work for local chapters is important at this time. we need to work with renewed vigour now and finish our task. pls help with increasing membership and join your state level chapter threads. I see only very few members have posted their interest. we need interest from each member in order to succeed. I am sure we will succeed. The good times are ahead of us but we need to take advantage of it.

I have a few questions regarding the application for AP for a dependent, and I would appreciate it if someone would answer them.
1. If the dependent is applying for AP, should I include the primary applicant's I-485 in the application packet?

Thank you for the overwhelming response. I did skim through the responses and agree with most of the suggestions/comments if not all.
Someone had brought the issue of FIFO and if there is anything in the law that states that FIFO has to be followed. I am not a law expert myself and cannot comment on if there is any such law. But what I am basing is more on the everyday commensense behaviour that all we humans follow for any queue. FIFO is the predominant thing being done for any queue and that will be the most resonable way to process be it a bunch of applicantions waiting on a queue or to service a number of people waiting on a queue in a bank or post office or whereever it might be. That is the fair, unbiased and non-preferential way of doing things. Isn't it?
I want to make sure to convey the point that I first of all wanted to bring this issue to everyone's attention. May be my message was worded strongly, but doesn't mean that I am not flexible.
I thought suing DOL is one of the options. Of course if there are other viable alternatives that will be less demanding, less expensive and will take a more non-confronting approach but still could have an equal impact in terms of resolving the issue amicably then I am all for it. But then the obvious question is what are the other equally good options? Someone mentioned about a petition. So what is a petition and how do we do it? Also mentioned was writing letters to congressmen etc. So who do we contact and how? Please, please anyone having the information please share.
One more thing is that I am all for a dialog with IV core members and their guidance for this. Since I started this thread doesn't mean that I wanted to sideline IVs, but this is the only way I thought I could communicate to the IV platform about the agony of this issue and how people have been affected by this. So I am all for talking with IV core members on this. But please let me know how I could do that?
So please let us start acting now: The list of next possible steps (in no particular order) are:
- Decide if there are viable alternatives to a lawsuit that is more non-confronting and first try them if possible
- Get the support of IV core team for this
- If no other alternatives are available then consider filing a case. Consult an attorney for this

- Raise some money towards this cause

3. Finally, nothing works and no one help us, file a lawsuit. (As I dont know anything about the lawsuit here, many of them mentioned that the lawsuit should be done by the employer and there is more possibility of loosing.. We should not lose heart on that. In the suit, we need to ask them to make it current and keep the same filing fees until 30 Sep 07)
P.S. As one of the posting mentioned, we may also consider waiting till Sep 07 before filing lawsuit. Because DOL promised to clear all cases before 30 Sep 07. If they dont then our case become more stronger. Till then we need to contact concerned people (like IV, congressman etc) and collect all infromation.

Agree with paskal. In fact from both Aman Kapoor as well as Tamsens experience, the only repercussion of getting active and visible in IV is that USCIS quickly gives you your GC (probably just to get you off their backs) :) Dont we all want that repercussion?

"It is important that we fix the legal immigration system, because right now we've got a backlog that means years for people to apply legally. They just can't afford it. It's discriminatory against people who have good character, but don't have the money. We've got to fix that. "
I know that's what he said but if you read that statement again, nowhere he talks about Highly skilled legal immigration. I think he is talking about the family based immigration, which again caters mostly to the Vote bank. From everything I have read, Obama seems to be anti-outsourcing and neutral (or maybe negative) towards highly skilled legal immigration

I have flown in these airlines so far and here are my comments
Delta - Oh sucks man !! - Thiruvallur bus (in tamil it means - a normal congested government bus)
Qatar airways - decent - except for the food which is no good and you dont get the polite service (even they will not even check back if the light is on).
Jet airways -- wonderful ! Excellent food ! Superb airhostesses ! Good leg space and quite comfortable flight
Indian airlines - Oh man ! what a journey between singapore to chennai. We started late by 3 hours as they took one flight off (cost cutting) and bundled all of those pax with us. And we had to land on exactly 1 wheel (i meant with 1 tyre remaining). Nose wheel had tyres blown out and the back wheel had one blowout. But hats off to the pilot who took us safely. No bassinets, but the crew was cooperative and gave us a bassinet that could be placed down in the floor near your leg. I will vote against the machines (IA) but support the crew.
Singapore airlines - Awesome and hats off so far ! Had a tough time getting a bassinet for my baby as there was a code share with indian airlines (of all airlines - oh my god!).
