Hi Pappu
Like me most of us would have got the reply from the Senetor or the congress man for the email that we sent. But all the replies are generic in nature and focus is on illegal immigration issue. The problems of "Legal immigrants" to my knowledge did not get their attention?. This is my observation.

The intent of this thread is good. There are however practical considerations.
Many of us are from India. In the era pre opening up its economy, we had many well educated folks unable to get jobs there. The socialist strangle was such that highly educated people had no suitable jobs and private enterprise was actively discouraged. Many sought economic and professional refuge in more capitalist economies and to some extent we are still seeing the spillover from the policies of that era, with an excess supply of human skilled capital there and opportunities still not able to spread to the whole economy/population.
The reason I am saying all this is, investing in skills like masters etc is generally a good thing, but not always. In fact there are many studies to prove this point, some demonstrate that too much education is a negative predictor of economic success.
In our situation, capital is important, whereever we end up. Since in a capitalist model money works for you, and obviously if you have enough of it then you can spend your time doing other things, charity work or whatever warms your heart. Doing an MBA or any other higher education is very expensive in america. It is an investment. If you end up here, it will perhaps turn out to be a good investment, otherwise it will be of limited use to us especially in India, especially if a global recession hits.

If that is so the capital preserved by not doing an MBA in a top ten school which I estimate to be about 60-70K if I am not mistaken might be put to another use.

I understand, that the rude part maybe new, but so was the aide's reponse to call our local Congressman. Hence was getting a bit hopeful that the Congressman may have made up his mind in the affirmative for these bills.

Does any one know how much IV collets in recurring contributions? How much did we collect for the DC rally and how much did we spend?
San Jose was a local CA event planned almost spontaneously. DC was an event planned months in advance. People were offered Free ride, Free plane fare, Free food (in Gurdwaras). Yet how many participated?
I have been refraining from posting on this point, as I wouldn't like to belittle the contributions of the strong team from California and the numbers they brought to the rally.
But let's face it. CA has more EB immigrants than the next three. Look at the recent 2006 Performance report from DoL (available at Mathew Oh website). CA had 21,000+ labor petitions compared to NY - 7,000, NJ - 7,000(?) , TX - 5000. As you can see CA scores more than the next three states put together.
If 40 people participate from NY, it's as good as 120 from Cal. Percentagewise it would be the same. If 40 peope walk in Michigan ( 2000 Labor petitions) statistically it would surpass CA, percentagewise.
It's a known thing that only 5%-10% of the population participates actively in the most successful movements be it American Revolution or struggle for Indian Independence. We haven't reached that critical mass yet ( at the regional level)
There is an enthusiasm right now. But how long before the fatigue sets in? Rallies need to be minimal, held with certain strategic target and should serve some specific purpose.
Weekend rallies attracting bigger crowds is a myth. Be prepared to listen to reasons like - Shucks I have to mow the lawn, take kids to Bharatanatyam dance classes, I have relatives over for lunch etc.
With that logic if we hold rallies over the LONG weekends, we should attract bigger crowd, since people have 2-3 days to relax afterwards. And since people already plan to visit Orlando, LA etc to visit Disneyland, Universal etc., if we can hold rallies there we should attract the highest possible crowd. Do you think my idea will work?
I agree with you 100%. Question is - who'll bell the cat? Who will take the lead and sacrifice their time, family life etc. to plan, organize and conduct these?
We need a fearless leader like Aman Kapoor, who can motivate and inspire people to participate, in every state. Where can we find them?
How about taking this to the next step and hire paid fulltime staff who can
1) call people and request donations
2) organize meetings
3) stimulate the local chapters
4) promote IV
..... and the list can go on.....and do all the things necessary to convert all propects to customers.
How about having full time offices in DC? This office will run on donations.
Finally, how about instead of anonymous members make this a place where everyone has to provide their personal details etc.
Anyways, I am just ranting.

This is something that we have not had time to discuss yet. I raised the idea a few days ago, but we are all very busy currently. btw I am not an official core member, but recently very active.

Few months back I was frustrated and was seriously considering going back to India. Until I had to visit Denver for some work last week (where I use to work before). I met one of my freind who is from India and after listening to his story I decided may be it worth waiting for GC. He never wanted to stay in US (not because of GC retrogression but for other reason) and on advise from his coworker he applied for GC. He got his GC in one and half year (wow !! great isnt it). Now look at the life style he is living beautiful house by the lake with view of mountains kids going to good school. He comes home for lunch, work is just couple of miles from home. Huge shopping malls at stone throw distance. Now he thank his ex-coworker for his advise as he and his family is living a wonderful life.
Its just matter of time. Lets look at the glass half filled rather than half empty few months back it was total darkness atleast now we have bills passed by Senate which incorporates IV goals (kudos to IV core and all members). All we can do is try as we did before. Lets renew our fight with full vigor we are half way through. Once it passes HR we are done. I urge all members to participate on Sunday's conference and plan new strategy.

Anybody thinking of this ...........
I know there is a whole lot of people asking if they can do a Executive MBA or Masters and qualify for the US Masters exemption. My question is, what about someone who started and did his Masters in his field of labor application from a accredited university, after applying for EB3 labor, and now has labor and 140 approved but waiting for PD, will this person also qualify for US Masters, or will he have to start a new labor application based on the masters degree ?

Since you are a Canadian you can apply for a visitor visa (B1) – by applying the visa we will be in legal status until a decision is taken. B1 visa is generally approved if you give the reason of finishing up matters in US (like selling house/cars/closing bank accounts/credit accounts etc). I guess you are asking just to be informed but if it really happens another option for you is TN1 – if you have not yet applied for 485.
But they never know when you leave really, at least if you're canadian. By going home, all I do is give the CANADIAN immigration officer the i-94 paper with the h1 stamp when i enter canada if i don't plan on returning to the US again, at least on that visa. Plus, they never ask, so it's really up to you to give it to them. And getting a visitor visa, canadians automatically enter on 6month visitor status as default, no stamping required. If you're flying, all you have to do is tell them you're coming back to canada. If you drive across the border, they don't care to ask. So i guess i can just hop back to vancouver for a weekend and come back as a visitor and be fine then (to clean up affairs, or just hang out for 6 months).

Guys, let me say something here.
$5000 for one query is not an unfair amount of money. The reason I say this is because I know a thing or two about writing quality queries, I have done that for the last 6 years of my 9 year career querying the heck out of Oracle CRM.
It does take time to write queries and the time it takes depends on how many pieces of information you want to bring together. The wider your spreadsheet is for the final output, the more islands of data need to be connected to fetch that output. Those who are familiar with SQL would know that I am talking about going thru potentially 20-25 tables and joining them to get data. This is probably not going to be a select * from 485_cases kind of query. If it takes 100 hours of time to write such a query, at $50 per hour of programming time, it could be 5000. Most likely it may be fewer hours if they have a programmer with knowledge on staff.
The problem here is not 5000 dollars. The problem here is that the situation is hopeless because they dont assign country of chargeability to pending 485 cases up until they are ready to approve them, if I read it correctly. The data that is not captured is the data that cannot be queried, simple as that.
And on that note, thanks to "Needhelp!" for shining some light on USCIS process thru her FOIA.

We should not waste our time and money on this. I also would like to understand the lobbying impact of IV. After hearing tech lobby brought CA governor into picture and even that does not make any difference in favor of tech companies, are we making any impact with 200-300 thousand lobbying and some web faxes?

Guest answered many questions personal - EB based immigration and other immigration but in my opinion we could get very precise answers on following questions raised by attendees in more clear manner without leaving any doubts and ifs and buts.

I think Both Sen.Obama and Sen.McCain are interested in legal Immigration. Mitt Romney was a big Advocate of legal Immigration. But of course, these are not the priority Items for both the candidates and also have to reassure the citizens that they will create new Jobs. Both of their plans will not affect Outsourcing
