Hi, my friend have not receive her fingerprint, her husband filed for I-485 on june 2007. their PD is 2004-ROW. their case forwarded into TSC. do you think this is normal ? what is the possible solution for this issue ?

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

Completed my 6 years on H1B and returned back to India on personal reasons.
1. When I apply for a new H1B after 1 year break, does the H1B comes under the quota or will it be considered on previously held H1B quota.
2. How sure about getting approval of H1B.

My wife and I got married here in the Phil.He wants to file for an immigrant visa.We've been searching on the internet for some info but unfortunately we have some problem with some sites coz we cant get access to it.I also want to know how long it'll take to process an immigrant visa and the fees.

You are already counted in the quota. So it is just transfer. But for transfer need recent paystubs. Consult a lawyer how to handle this. Definitly you no need to wait for April 1 st quota for new H1B.

Can students with post completion EAD work for more than one employer at the same time in their own speciality area? I mean to ask, can they work full time with one and part time with other?

I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?
Thanks in advance for your advice!

How about this ? Lets say your consulting firm is ready to file your I-485 upon lots of restriction such as two year agreement and to spend around 10 gran.
While the big firm who has filed the PERM and waiting for the approval. In this case, can we do both the cases to see which is better upon the current situation.
This will help few of our folks and your thoughts are always appreciated.

My I-485 is pending with EB3 Feb 2006 priority date. Invoked AC21 and currently working for a different employer. Have Masters degree and 9+ years of experience.
Is there a way to re-apply for Green Card under EB2 category thru a 3rd employer and retain the old EB3 priority date?

Dear Attorney,
I work for a non-profit State University (6+ years), and my supervisor is letting me work from Canada for a year or so. As my university HR needs to have an H1B permit to keep me on the payroll, my University's International Officer is willing to keep my permit valid and keep renewing it even beyond 6 years as my I-140 is approved. She says that I can also apply for an H1B visa in Canada and visit US whenever my supervisor asks me to do so.
Wondering if this is doable without violating the USCIS & LCA rules and regulations? Thanks.
